Agreement to Terms

By accessing or using App Factory ("Service"), including the website at factoryapp.dev and any related tools, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

App Factory is an open-source AI-powered pipeline for generating mobile applications. The CLI tool runs locally on your machine and is distributed under the MIT License. This website provides documentation, account management, and optional cloud features.

Open Source License

The App Factory CLI and pipeline tools are open source software licensed under the MIT License. You may use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions of the MIT License.

The full license text is included in the software repository. These Terms of Service apply specifically to the use of this website and its online features, not to your local use of the open-source software.

Account Registration

To use certain features of the Service (such as saving favorites and tracking builds), you must create an account. When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account

You may authenticate via email/password or GitHub OAuth. If you use GitHub OAuth, you authorize us to access your public profile information as described in our Privacy Policy.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service to generate applications that violate any applicable law or regulation
  • Generate applications containing malware, viruses, or other harmful code
  • Generate applications that infringe on intellectual property rights of others
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated scripts to collect information from or interact with the Service without permission

Generated Applications

Applications you generate using App Factory are your property. You own the code and assets produced by the pipeline, subject to:

  • Third-party licenses of dependencies included in generated applications (e.g., React Native, Expo, RevenueCat SDK)
  • Any licenses applicable to assets or content you provide as input

You are solely responsible for reviewing generated code, ensuring it meets your requirements, and complying with all applicable laws and third-party terms when publishing or distributing generated applications.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Generated applications will be free of bugs or defects
  • Generated applications will be suitable for app store submission
  • Generated applications will comply with any particular legal requirements
  • The results of using the Service will meet your requirements

You acknowledge that AI-generated code may contain errors, security vulnerabilities, or other issues, and that you are responsible for reviewing and testing all generated output before use.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL APP FACTORY, ITS DEVELOPERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any bugs, errors, or defects in generated applications
  • App store rejection of generated applications
  • Unauthorized access to or alteration of your data
  • Any third-party conduct on the Service

Indemnification

You agree to indemnify, defend, and hold harmless App Factory, its developers, contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Applications you generate and distribute
  • Your violation of any rights of another party

Account Termination

You may delete your account at any time through the account settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. We will make reasonable efforts to notify you before suspension or termination, except where immediate action is necessary to protect the Service or other users.

Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top indicates when these Terms were last revised.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
